With the advent of the "first inventor to file" provision under the America Invents Act enacted in 2013, the need for inventors

to file patent applications as soon as possible to protect their innovations has never been more important.

Identifying this urgency, Patents Atlantic, Inc. was organized and structured to provide the vehicle by which provisional applications could be more quickly and efficiently filed.

Patents Atlantic is premised on obtaining provisional patent application filing dates as quickly as possible for its customers.

NOTE: Offers to sell or the sale of an invention at anytime prior to filing a patent application to protect said invention functions to statutorily prohibit the grant of a patent on said invention under Federal Law. 35 U.S.C. §102(a).

Therefore, in the event an invention is sold or offered for sale prior to filing a patent application, the inventor (or any other person or entity) is prohibited from filing a patent application to protect the invention via patent grant under 35 U.S.C. §102(a).

Significantly however, immediately upon filing, the invention acquires Patent Pending status—thereby providing the inventor with the comfort and knowledge that he/she may thereafter market, sell, or offer to sell his/her invention without risk of losing possible patent rights under 35 U.S.C. §102(a).

Utility Patent Applications

A provisional patent application expires twelve (12) months from the filing date. Thus, should an inventor decide to continue protection past one year, inventor must file a non-provisional (utility) patent application claiming priority to the earlier-filed provisional application before the provisional expires in order to preserve the benefit of the provisional filing date.
